Tom Brownlee

Tom Brownlee called to the Bar in 2021 after 10 years as a Solicitor and Solicitor Advocate.

He brings a wealth of experience in all areas of personal injury litigation with a particular focus on road traffic, employers’ liability, large loss, and catastrophic injury cases. He is experienced in the quantification, negotiation, and settlement of high value claims.

Tom has significant experience of representing corporate entities and individuals in the Court of Session, Sheriff Appeal Court and Sheriff Courts across the country. He has a balanced practice between Pursuer and Defender work. Tom is also regularly instructed in Fatal Accident Inquiries.

Robert Miller v West College Scotland (ASPIC 2021)
For the Defender. Work place accident involving questions of Vicarious Liability and the Employers Liability (Defective Equipment) Act 1969. Decree of Absolvitor granted after proof with expenses in favour of the Defender.

Pawel Michalski and Anita Kmiecik v Mr McSweep and Aviva Insurance  (Paisley Sheriff Court 2023)
For the Defender. Road Traffic Accident involving low velocity impact. Decree of Absolvitor granted after proof with expenses in favour of the Defender.

Natalie Manley v Thomas McLeese (ASPIC 2023)
For the Pursuer. Road traffic accident. Unsuccessful at proof. Decision later overturned insofar as it related to QOCS by the Sheriff Appeal Court, Robert Milligan KC instucted.

Nigel Dick v Joseph Merrick [2024] CSOH 39
For the Defender. Proof restricted to liability, considering the liability of two cyclists who collided on a cycle path. Liability established against the Defender with 50% deduction for contributory negligence.

Louise Baxter v EUI Limited (Glasgow Sheriff Court 2025)
For the Defender. Case involved a road traffic accident which raised questions of credibility, reliability and admissability of expert evidence. Decree of Absoilvitor granted after proof.

Mohammed Tanveer v Aviva Insurance Limited (Glasgow Sheriff Court 2025)
For the Defender. Case involved a road traffic accident which raised questions of credibility, reliability and admissability of expert evidence. Decree of Absolvitor granted after proof. 

Mark Andrew Card v Chief Constable, Police Service of Scotland [2025] SC EDIN 81
For the Pursuer. The case concerned a serious and career-ending assault on the Pursuer, who was an operational police response officer, who had been tasked (along with others) to deal with an escaped suspect, who was armed with a knife. Graeme Middleton KC and Tom Brownlee represented the Pursuer who was successful after proof.

FAI - Death of "WS"  [2023] FAI 31
Represented the Scottish Ambulance Service Board in the Inquiry into the death of a care home resident. 

FAI  - Death at Kilgallioch Wind Farm [2024] FAI 50
Represented the Scottish Ambulance Service Board in the Inquiry into a death on a Wind Farm. 

FAI - Stonehaven Train Derailment 2026
Represented the Scottish Ambulance Service throughout preparations for the Inquiry. Scottish Ambulance Service released from the FAI prior to the evidential hearing.
