Robert Kinghorn v Martin Acoustics Ltd – GLW-PD361-21
The court rejected the pursuer’s contention that he should be allowed to proceed with an asbestos related claim despite the triennium having expired. The pursuer was deemed an unreliable witness and furthermore failed to give an explanation to account for the failure to raise an action during the intervening period.
