Kay Springham KC and Dominic Scullion appear in UK Supreme Court

Kay Springham KC and Dominic Scullion, Advocate recently appeared in the UK Supreme Court in a landmark action for damages brought by a lawyer against the Lord Advocate for assaults allegedly committed by a judicial office holder. The arguments presented in London concerned the interpretation of the Crown Proceedings Act 1947 and whether sheriffs are ‘servants of the Crown’. Kay and Dominic were led by the Solicitor General for Scotland, Ruth Charteris KC; and in-line with the UKSC’s recent practice note, the oral argument was split between senior and junior counsel, with Dominic presenting a chapter of the submissions on behalf of the Lord Advocate.
