JWE v LGBT Youth Scotland - [2026] CSOH 6
Lord Braid has issued his opinion in JWE v LGBT Youth Scotland following a Debate where Compass Advocates Bruce Langlands appeared for the Pursuer and Adam Black for the Defender.
As a child, the pursuer attended upon the defender’s organisation for support and assistance, whereupon he alleges he was groomed by its workers with the provision of cigarettes and alcohol, that he was provided with false ID and taken to adult venues, and that once there he was encouraged by one of the defender’s workers to engage in sexual activity with third parties in exchange for payment. The case involves consideration of whether a Delict of grooming is recognised in Scots law and whether the defender can be liable for harm caused by third parties unconnected to its organisation.
