HMA v MM

A lorry driver charged with causing death by careless driving following a fatal collision with a pedestrian was acquitted by a jury at Glasgow Sheriff Court on Tuesday 27 May 2025.

The fatal accident occurred at Duke Street in Glasgow on 1 June 2023.

The driver of the heavy goods vehicle was waiting momentarily in a queue of traffic when the pedestrian attempted to cross the road in front of the vehicle as it moved off.

Evidence was led over 6 days, and the Crown case was that the lorry driver had failed to keep proper observation or use her mirrors. There was CCTV footage of the incident from a nearby shop, and the prosecution case was based on interpretation of that CCTV footage by police forensic collision investigators and road accident reconstruction. The police reconstruction evidence was detailed but following cross examination the jury acquitted the accused delivering a unanimous not guilty verdict.

John Scullion KC was Counsel for the driver of the lorry.
