Ema Chan v The National Crime Agency

Today a Proof will commence in ASPIC where the pursuer will seek to establish that her hearing loss was caused by the defender negligently exposing her to the noise of a fire alarm being tested. The pursuer will argue that the risk of injury was not reduced to the lowest level reasonably practicable, notwithstanding that the noise did not exceed any of the exposure action values in the Control of Noise at Work Regulations 2005. Instead, the case will turn on the application of Regulation 6(1), which has not yet been tested in this manner before the Scottish courts.
