Grant Markie

Year of Call 2014

Since calling to the bar in 2014, Grant has developed a personal injury practice acting for pursuers and defenders in relation to road traffic accidents (including catastrophic injury), injuries in the work place, industrial disease (including fatal and living mesothelioma cases), medical, dental and nursing negligence litigation.

Grant has a particular interest in fatal cases and their valuation and the use of Ogden Tables and co-wrote an article which can be found here. Grant is currently instructed on behalf of the surviving relatives in relation to the sinking of a fishing vessel in 2016.

In relation to clinical negligence cases, Grant has been instructed on behalf pursuers, health boards and GP’s. His experience includes actions arising from a failure to diagnose meningitis, injuries sustained during surgery and vaginal mesh litigation.

Grant has appeared in the Court of Session (Inner and Outer House), All-Scotland Personal Injury Court, Sheriff Appeal Court (both Civil and Criminal) and many Sheriff Courts throughout Scotland.

Grant also has a criminal practice and has represented clients in the High Court of Justiciary and Criminal Appeal Court. He is an Ad Hoc Advocate Depute and is also Standing Junior Counsel to the Advocate General.

Natalie Harper v Matthew Kitching 2021 Glasgow Sheriff Court Unreported

Acted for the pursuer in relation to road traffic accident. The pursuer was unable to identify the driver of the other vehicle involved. Succeeded after proof relying on presumptions applicable to owner and registered keeper of vehicles. 

Leslie O’Donnell v Smith and Royal and Sun Alliance [2018] SC EDIN 68
Acted for the pursuer in relation to a road traffic accident where the pursuer was travelling behind a vehicle who carried out an emergency stop. Liability was denied at proof. Pursuer succeeded with no finding of contributory negligence.

Marshall v DHL Supply Chain Ltd ASPIC 2020 Unreported (Sh Dickson)
Acted for the defenders in relation to an accident at work as a result of a piece of work equipment which failed. Following proof, decree of absolvitor for the defenders.

Fordyce and Others v Craddock Court of Session 2020 Unreported
Fatal road accident claim, acted as junior counsel for multiple pursuers;

Morrison and Others v Kennedy and Others Court of Session Ongoing
Acted as junior counsel for pursuers following the sinking of a fishing vessel in 2017; complex loss of support claim calculations involving split multipliers and use of the Ogden Tables.

MB v Lanarkshire HB [2019] SAC (CIV) 21
Acted for the pursuer in relation to alleged negligent insertion of a catheter. Conducted proof and appeal proceedings in the Sheriff Appeal Court; issues of inferences that can be drawn from primary findings in fact.

Taylor and Others v Myskow and Others Court of Session 2019 Unreported
Acted as junior counsel for a GP (defender) in relation to an alleged failure to diagnose meningitis; fatal claim

Criminal Cases

Janet Farquhar v HMA [2018] HCJAC 56
Acted for a 70 year old accused who had pled guilty to embezzlement of circa £70,000 from Church funds. Sentence of imprisonment imposed at first instance, quashed on appeal.

Pf(Greenock) v Rev Douglas Cranston Unreport Sh Court Greenock 2019
Acted for a minister of the Church of Scotland in relation 9 charges of fraud and embezzlement. Acquitted of all charges following trial;

HMA v Hogg Unreported High Court of Justiciary 2013 (Lord Brodie)
Defended an accused charged with causing death by dangerous driving, convicted of lesser charge of death by careless driving .
