David Nicolson

Year of Call 2005

David called to the Bar in 2005 after spending 14 years as a criminal defence solicitor.

He has a well established Regulatory Crime practice with particular experience of cases involving fatal road traffic accidents.

David was a full time Advocate Depute from 2011-2015 including spending two years in the National Sex Crimes Unit in Crown Office. He regularly sits as a Legal Chair on the Parole Board.

Representative Cases

2021: HMA v GD – Lorry driver charged with causing death by careless driving. Acquitted after trial in the Sheriff Court.

2021: HMA v JC – Lorry driver charged with causing death by careless driving. Acquitted after trial in the Sheriff Court.

2020: HMA v PMCC – defended school pupil accused charged with serious sexual offences. Acquitted after trial in the High Court.

2020: HMA v DG – defended accused charged with multiple sexual offences in the High Court.

2019: Children’s Reporter v AM – Sheriff Court referral in which instructed to act for a school pupil charged with rape. Grounds not established after proof at the Sheriff Court.

2019: HMA v WM – driver charged with causing death by careless driving. Acquitted after trial in the Sheriff Court.

2019: PF v JB – driver charged with dangerous driving causing serious injury. Acquitted after trial in the Sheriff Court.

2016: HMA v PC (and others) – junior counsel instructed in the defence of a London accountant charged with fraud as part of the “Rangers case”.
